A legal guardianship may be set up in order to ensure someone is protected and cared for beyond their 18th birthday. Parents are not automatically legal guardians, even of their own child, once the child becomes an adult, regardless of how severely impaired their child may be. In Texas, guardians are appointed in a hearing at a probate court where a judge determines the extent to which a person is able to manage their own affairs and what matters the guardian is responsible for (legal affairs, medical treatment, service-related issues). The guardianship can be customized to meet the needs of the specific individual.
